Finding a lawyer is not always an easy task; and when it comes to immigration, the one you choose can literally save or ruin your future in this country. Allen Jay Charne and Libby Vazquez from the New York City Bar Association give their advices on how to make a good choice.

How to verify if someone is a licensed lawyer in New York?
You can call the office of court administration, or visit their website at www.courts.state.ny.us. If you type the first and last name of the person who claims to be a lawyer, it will show whether or not this person is licensed to practice in NY, when they were admitted to practice, and which law school they went to. That would be an easy way of finding out if somebody is a lawyer or not.

When you have, for example a list of 10 lawyers, and you don’t know any of them, what should be your criteria for choice?
It’s important to look into their experience and how many years they have been practicing. You can also look into referrals. If somebody has used that person as his or her attorney, try to find out if that person can give you a good reference.

It also depends on what kind of problem it is. If they are dealing with deportation, then they really have to speak to someone who has direct experience with deportation. One of the many ways that people get into trouble is by pleading guilty to a somewhat minor criminal offense only to save money. If someone has a criminal case against them, they want to make sure that their criminal defense lawyer is familiar with immigration laws, or actually works with an immigration lawyer in trying to find the best advice and the approach.

Aren’t some lawyers specialized?
Lawyers are not supposed to use the word “specialized” in NY. They use an euphemism that they concentrate their practice in. The reason why they are not supposed to use the word “specialized” is because there is not a test or an official body that certifies that they are specialized. They may concentrate their practice in a certain area of law; but when they use the term specialized, it doesn’t have the same meaning here than it does in states like California, where there is a specialization test and a board that oversees specialization.

Comment peut-on savoir si une personne a réellement le droit d’exercer en tant qu’avocat à New York?
Si vous voulez savoir si une personne a la licence pour exercer à New York, vous pouvez appeler le bureau du tribunal ou visiter leur site internet au  www.courts.state.ny.us. Si vous tapez le nom et le prénom de la personne qui prétend être avocat, vous verrez si cette personne a la licence ou pas, la date à laquelle elle l’a obtenue et l’école qu’elle a fréquentée.

Quand vous avez par exemple une liste de 10 avocats et vous ne connaissez aucun d’entre eux; quels doivent être les critères de sélection?
Il faut s’attarder sur l’expérience : depuis combien d’années pratique-t-il ?  La réputation est aussi importante. Si possible, chercher à rencontrer  quelqu’un qui s’est  déjà attaché les services de cet avocat et voir si cette personne peut faire une bonne recommandation.

Il y a aussi le rapport entre la nature du problème et les compétences de l’avocat. Si vous êtes par exemple sous la menace d’une déportation, vous devez vous adresser à quelqu’un qui a une expérience directe avec la déportation.

Beaucoup trop souvent, par souci d’économiser de l’argent, certains plaident coupables pour ce qui semble être une violation criminelle mineure sans savoir que cet acte va plus tard leur causer de gros problèmes. En cas de contentieux, ils doivent s’assurer que l’avocat de la défense à qui ils s’adressent connait bien la loi sur l’immigration ou travaille avec un avocat qui maîtrise parfaitement cette loi  pour trouver le meilleur conseil et la meilleure approche.

Certains avocats ne sont-ils pas spécialisés?
Les avocats ne sont pas censés utiliser le mot « spécialisés » à New York. Ils utilisent l’euphémisme : « concentrent leur pratique dans ». La raison pour laquelle ils ne doivent pas utiliser le mot « spécialisés » est qu’il n’y a pas de test et un corps officiel certifiant qu’ils sont spécialisés. Ils peuvent concentrer leur pratique dans un secteur particulier du droit mais quand ils utilisent le terme « spécialisés », cela n’a pas la même signification qu’en Californie où il y a un test de spécialisation et un conseil qui supervise cette spécialisation.
